The most popular way of starting a business in Ireland is to register a Business Name. 25,795 business names were registered for sole traders and partnerships in Ireland in 2013. In comparison 15,506 new limited companies were formed.
It is necessary to register a business name at the start of the business if a company, individual or partnership wishes to trade under a name that is not its own name. The purpose of that regulation is to publish the identities of legal entities behind the business names.
Before your business registration you have to meet several requirements:
- The business needs to be established in the Republic of Ireland
- The registering entity needs to be an Irish resident. However, if the registering person is a non EU-national, a Stamp 4 and Permission of the Minister of Justice, Equality and Law Reform is required.
- If the business name contains a domain name suffix or prefix, a proof of the domain name ownership is required.
- It is permitted to register names with Irish company type suffixes, e.g. Limited, Teoranta or Company
The CRO doesn’t check the desired name for any similarities with existing names. Hence the name can be any name, even if there is already a registered business with this name. But this also means that there is no protection of the name, as anyone can register any business name they want.
The type of form depends on the entity that wishes to register a business name. After filing the form a signature page has to be sent to the CRO. It takes about three weeks until the business registration is completed and the certificate will be issued.
